Terms.

These Terms of Service (the “Terms”) govern your access to and use of Daily Card Show, a peer-to-peer marketplace for trading cards, graded slabs, and sealed collectible product (the “Platform”). The Platform is owned and operated by Must Haves, Inc., an Indiana corporation (“Must Haves,” “we,” “us,” or “our”). By creating an account, posting a want, listing an item, sending a message, or otherwise using the Platform, you agree to be bound by these Terms. If you do not agree, do not use the Platform.

1. Who we are, and what the Platform is

Daily Card Show is a venue. We connect individual buyers and sellers so collectors can find the cards they are hunting and sellers can fulfill those wants. We are not a party to any transaction between users. We do not own, take possession of, inspect, authenticate, appraise, or warrant any item listed on the Platform unless we expressly state otherwise in writing for a specific item.

Sellers are solely responsible for their listings, the accuracy of their descriptions and photos, the authenticity and condition of their items, pricing, packaging, shipping, and fulfillment. Buyers are responsible for reviewing listings, asking questions before purchasing, and completing their side of any agreed transaction.

2. Eligibility

You must be at least 18 years old and able to form a legally binding contract to use the Platform. The Platform is not directed to, and may not be used by, anyone under 18. By using the Platform you represent that you meet these requirements and that you are not barred from using it under the laws of your jurisdiction.

3. Accounts and account responsibilities

You agree to provide accurate, current information when you register and to keep it up to date. You are responsible for safeguarding your login credentials and for all activity that occurs under your account. One human, one account. You may not create accounts using automated means, impersonate another person, sell or transfer your account, or share it with others. Notify us promptly if you suspect unauthorized use of your account.

4. Seller certification and verification

Sellers, including founding and verified sellers, may be required to complete identity verification before listing items or responding to wants. By becoming a certified seller, you represent that the identifying information you provide is true and belongs to you, and you authorize us to verify it and to verify graded-slab certificate numbers against the grading company's records. Seller badges reflect that a verification step was completed; they are not a guarantee by us of any item, transaction, or outcome. We may suspend or revoke certification at any time for cause.

5. Listings and conduct rules

All listings must comply with our Prohibited Items Policy and Acceptable Use Policy, which are incorporated into these Terms by reference. Among other things:

  • You may list only authentic items you own and have the legal right to sell.
  • Listings for graded slabs must include a valid certificate number that matches the item and the grading company shown (PSA, BGS, CGC, SGC, TAG, or similar).
  • You may not list raffles, mystery boxes, repacks, randomized “breaks,” “spin to win,” or any other structure that places a chance element between payment and what the buyer receives. This is strictly prohibited.
  • Altered, trimmed, restored, or otherwise modified cards must be clearly and accurately disclosed as such.

6. Offers and transactions

The Platform lets buyers post wants and lets sellers respond with offers. An agreement to buy and sell is formed directly between the buyer and the seller. We are not a party to that agreement and do not guarantee that any want will be fulfilled, that any offer reflects fair market value, or that any item will be as described. You agree to deal honestly and in good faith with other users.

7. Payments — our role and Stripe's role

We do not take custody of buyer funds. When payments are enabled, they are processed by Stripe, Inc. through Stripe Connect. Stripe is the payment processor and the money transmitter for transactions on the Platform; Stripe holds the applicable money transmission licenses and routes funds from buyers to sellers. By accepting payment through the Platform, sellers agree to the Stripe Connected Account Agreement and the Stripe Services Agreement, and acknowledge that payment services are provided by Stripe, not by Must Haves. We never route buyer payments through our own bank accounts or hold seller balances outside Stripe.

8. Fees and taxes

Joining and posting are free. Transaction or seller fees may apply according to the fee structure published on the Platform from time to time, including reduced rates for founding sellers. We will make the current fee structure available to you before you incur any fee, and we may change fees on a going-forward basis with notice. Any applicable Stripe processing fees are separate.

Sellers are responsible for their own income taxes. Where required, sales tax may be collected and remitted, and tax forms such as a 1099-K may be issued, through Stripe in connection with your payouts. You are responsible for understanding your own tax obligations.

9. Authenticity and counterfeits

Sellers warrant that every item they list is authentic and accurately described. Counterfeit, replica, or reproduction cards and slabs, tampered or fake graded holders, and resealed or “weighed” packs are strictly prohibited. If we receive a credible report that a listing is counterfeit, tampered, or misrepresented, we may remove it, reverse or freeze related payouts, and take action against the seller's account. Sellers who repeatedly list counterfeit or tampered items will be permanently banned, and we may cooperate with law enforcement and rights holders.

10. Disputes and refunds

Because each sale is between a buyer and a seller, disputes should first be raised directly with the other party through the Platform. We may, but are not obligated to, assist in resolving disputes. Where we offer buyer protection or a dispute window, items that are materially “not as described” or that fail authentication may qualify for a remedy; buyer's remorse generally does not. Refunds, when due, are processed through Stripe. We may freeze a seller's payouts on items subject to a chargeback or dispute until the matter is resolved.

11. Intellectual property and DMCA

The resale of authentic trading cards is generally protected by the first-sale doctrine, and nothing here interferes with your right to resell items you legitimately own. You may not, however, use a rights holder's trademarks to imply endorsement, sell IP-infringing or counterfeit goods, or post content you do not have the right to post.

We respect intellectual property rights and respond to notices of alleged copyright infringement under the Digital Millennium Copyright Act (DMCA). If you believe content on the Platform infringes your copyright, send a written notice to our designated DMCA agent that includes: (a) your physical or electronic signature; (b) identification of the copyrighted work claimed to be infringed; (c) identification of the material claimed to be infringing and enough information for us to locate it; (d) your contact information; (e) a statement that you have a good-faith belief the use is not authorized; and (f) a statement, under penalty of perjury, that the information in your notice is accurate and that you are the rights holder or authorized to act on their behalf.

DMCA Agent:Copyright Agent, Must Haves, Inc. — email legal@dailycardshow.com. We will process valid takedown notices, notify the affected user, and honor proper counter-notices in accordance with the DMCA. Repeat-infringer policy: we will terminate, in appropriate circumstances, the accounts of users who are repeat infringers of copyright or other intellectual property rights. Submitting a knowingly false notice may subject you to liability under Section 512(f) of the DMCA.

12. Disclaimers

The Platform is provided “as is” and “as available” without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Platform will be uninterrupted or error-free, or that any item, seller, buyer, listing, or transaction is authentic, accurate, lawful, or will meet your expectations. You use the Platform and transact with other users at your own risk.

13. Limitation of liability

To the fullest extent permitted by law, Must Haves and its officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the Platform or any transaction with another user. To the fullest extent permitted by law, our total liability for any claim relating to the Platform will not exceed the greater of the fees you paid us in the twelve months before the claim or one hundred US dollars (US$100).

14. Indemnification

You agree to indemnify and hold harmless Must Haves and its affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to your listings, your items, your transactions, your content, your use of the Platform, or your violation of these Terms or of any law or third-party right.

15. Termination

You may stop using the Platform at any time and may request that we close your account. We may suspend or terminate your access at any time, with or without notice, if you violate these Terms or our policies, if we are required to by law, or to protect the Platform or its users. Sections that by their nature should survive termination — including disclaimers, limitation of liability, indemnification, and governing law — will survive.

16. Governing law

These Terms are governed by the laws of the State of Indiana, without regard to its conflict-of-laws rules. Subject to any applicable mandatory law, you agree that the state and federal courts located in Indiana will have jurisdiction over any dispute that is not otherwise subject to an agreed dispute-resolution process.

17. Changes to these Terms

We may update these Terms from time to time. When we make material changes, we will update the “Last updated” date above and, where appropriate, provide additional notice. Your continued use of the Platform after changes take effect means you accept the revised Terms.
